Posey A motion was made by Supervisor Parlin, seconded by Supervisor Hidahl to: 1) Adopt and authorize the Chair to sign Resolution 148-2024 entitled the Building Industry Advisory Committee (BIAC), superseding prior Resolution 164-2010, adopted by the Board on October 12, 2010, to revise the BIAC’s roles and responsibilities to align with the current structure and focus of the Planning and Building Department with the following changes to the Resolution: a) Add the following language: Section 3. Responsibilities: The Building Industry Advisory Committee will engage with stakeholders, including community members, advocacy groups, and industry professionals to make recommendations to the Board of Supervisors and the Planning and Building Department on process improvements that support Resolution 014-2024 adopted by the Board on February 6, 2024. The Committee shall report back annually until the directives of Ordinance 014-2024 have been implemented. The Committee may make recommendations regarding Ordinances, Resolutions, Policies and Procedures related to the building industry as directed by the Planning and Building Director; b) Correct the reference to the Ralph M. Cauve A motion was made by Supervisor Hidahl, seconded by Supervisor Thomas to Continue this matter to October 15, 2024 with the following direction to staff to: 1) Recognizing that staff is bringing an update on the Ranch Marketing and Winery Ordinance on September 24, 2024, direct staff to include a high-level scope and schedule to revise the Ranch Marketing and Winery Ordinance to address the issues raised today including but not limited to: hosted rentals, detached guest houses, and Vacation Home Rentals (VHRs); 2) In Section 5.56.030, include the provisions of this chapter to apply only within the unincorporated area of the County. All requirements, regulations, and standards imposed by this chapter are intended to apply in addition to any other applicable requirements, regulations, and standards imposed elsewhere in this Code. The provisions of the section shall apply to all hosted and vacation home rentals. Notwithstanding anything contained herein, in the event of a conflict between any provision of this Chapter and any provision of Chapter 130.44 (Ranch Marketing) or Section 130.40.400 (Wineries), the applicable provision of Chapter 130.44 (Ranch Marketing) or Section 130.40.400 (Wineries) shall prevail and any activities conducted in accordance with Chapter 130.44 (Ranch Marketing) or Section 130.40.400 (Wineries) shall not constitute a violation of this Chapter. Hosted and vacation home rentals, as defined below, shall not be permitted on vacant land, in non-habitable structures, accessory structures, detached guest houses; within accessory or junior dwelling units; or in structures or dwellings with County covenants or agreements restricting their use including, but not limited to, affordable housing units, agricultural employee units, farmworker housing, or farm family units. Tents, yurts, RVs, tiny homes (with or without wheels), or any accessory structure including other provisions intended for temporary occupancy are not allowed to be used as or as a part of a hosted or vacation home rental. This section does not supersede the permitting requirements for Campground and Recreational Vehicle Parks and Lodging Facilities, which are regulated by Section 130.40 of the El Dorado County Code of Ordinances. 3) In the last paragraph in the last sentence include Bed and Breakfast Inns; 4) In Section 5.56.090(3), include hot tub restrictions are not applicable to owners of the property; 5) In Section 5.56.100, include language that parking must be contained within the parcel; 6) In Section 5.56.140(A), clarify who is responsible for violations whether it be the host or owner; 7) In Section 5.56.140(E), change the language to “after a property has three violations within any twenty-four month period”; 8) Clarify where renters can locate emergency evacuation information; and 9) Decrease the Vacation Home Rental permit cap to 600 homes.
